DELIVERY AND SHIPPING TERMS

  1. Shipping and delivery: Agricultural Company Podere San Bartolomeo through, where necessary, special couriers and forwarders of confidence including DH, or other that will be communicated by e-mail to the customer at the time of the completion of the order for shipment, will deliver to customers the required products to the address specified at the time of order in the form "purchases".

  2. The contract is finalized with the delivery of the goods by the Agricultural Company Podere San Bartolomeo to the courier. As far as the transport and delivery of the goods are concerned, the conditions of the transport contract established by the Courier shall apply. 6.DHL's Responsibility

6.1 In respect of any individual Shipment, DHL's liability for international air cargo (including ancillary ground transportation services) for loss and damage is limited, in accordance with the Montreal or Warsaw Convention, as applicable, or in the absence of any Convention, to the lesser of (i) the current market value and the declared market value or (ii) 19 Special Drawing Rights per kilogram (approximately USD 26 per kilogram), up to a maximum of $100 (agreed at 80 €). This limit shall also apply to all other forms of carriage except as set out below.

For international land transportation, DHL's liability for loss and damage is limited under the International Convention for the Carriage of Goods by Road (CMR) to the lesser of (i) the actual market value and the declared value or (ii) 8.33 Special Drawing Rights per kilogram (approximately USD 14), up to a maximum of $100 (agreed in 80 €)For domestic transportation, DHL's liability for loss and damage will be limited to 1 € per kilogram, up to a maximum of 30 €.

If the Sender wishes to cover any damages in amounts other than those set out above, it shall make a specific declaration of value and apply for insurance as described in section 8 below, or arrange insurance itself. DHL's liability is strictly limited to direct loss and damage to the Shipment to the extent set out in Section 6 of this document. Compensation for any other loss or damage is excluded (including but not limited to loss of profit, profit, interest, loss of opportunity), regardless of the nature of the loss or damage, even if the risk of a potential loss or damage has been communicated to, or otherwise known to, DHL.

6.2 DHL will use its best endeavours to ensure that shipments are delivered in accordance with the delivery times notified by DHL, without giving any guarantee in this respect, taking into account the fact that such delivery times are indicative, are not binding and do not constitute a contractual obligation. DHL shall not be liable for any loss or damage caused by delay, but the Shipper, for certain Shipments, may claim compensation under the Money Back Guarantee.

 

  1. Methods of payment

The payment of orders can be made in the following ways:

3.1 Paypal: through this form of payment, at the same time as the conclusion of the online transaction, all financial information (card number, expiration date, etc..) will be automatically forwarded, via encrypted protocol, to the bank of reference that will debit the current account of the customer, the payment of the amount related to the purchase made.

The Agricultural Company Podere San Bartolomeo uses the system of payment by credit card in PayPal circuits.

  1. In case of cancellation of the order, both by the customer, as described in the following article, and by Podere San Bartolomeo, in case of non-acceptance of the order itself, will be required to cancel the transaction. Once the transaction has been cancelled, in no case can the Company be held responsible for any damage, direct or indirect, caused by the delay of the operation itself.

  2. At no time during the purchase process is the Company able to know the information relating to the buyer's credit card, transmitted via secure connection directly to the site of the bank that manages the transaction. No computer file of the Company itself will keep such data and in no case, therefore, Podere San Bartolomeo can be held responsible for any fraudulent or illegal use of credit cards by third parties, upon payment of products purchased.

  3. Credit card: Confidential credit card information (card number, holder, expiry date, security code) is encrypted and thus transmitted to the payment service provider. The Company therefore

  4.  never has access to and does not store the data of the credit card used by the Customer to pay for the products, even if the same proceeds to save the credit cards, except only the data relating to the holder of the card.

  5. Anticipated Bank Transfer: in case of payment by Anticipated Bank Transfer, what the customer ordered will be kept committed until receipt of proof of transfer, to be sent to the Agricultural Company Podere San Bartolomeo by e-mail info@poderesanbartolomeo.com no later than 5 working days from the date of acceptance of the order. The sending of the order will take place only at the time of the actual crediting of the amount due on the current account of the Company which must take place within 7 working days from the date of acceptance of the order.

  6. BANK DETAILS: The bank details necessary to make the payment by bank transfer will be communicated, after receipt of the order, with a specific email sent by the Agricultural Company Podere San Bartolomeo. After these deadlines, the order will be deemed automatically canceled. The reason for the bank transfer must include the reference number of the order, the name and surname of the consumer or the name of the company or natural person in the case of a professional.

 

  1. At the time of delivery of the goods by the courier, the customer is required to check: that the quantity of goods ordered corresponds to what is indicated in the order, that the packaging is intact, not damaged, nor wet or altered even in the closing materials. Any damage must be immediately reported to the carrier who makes the delivery. Once signed the document of the courier, the customer can not make any objection about the external characteristics of what is delivered.

  2. Delivery times: Delivery times are set by the courier. The times indicated in the online shop pages of the site are indicative and are in any case related to the activity of the courier. With regard to the preparation of the shipment for delivery to the courier, the Agricultural company Podere San Bartolomeo will proceed to the same within 3 working days from the completion of the order, unless different times resulting from the availability of the product or organizational needs that will be promptly communicated by e-mail to the customer.

  3. Delays in delivery: any delays in the delivery of goods can not be charged or attributable to the Agricultural Company Podere San Bartolomeo, nor, in any way, the Company can be held responsible for damages caused by the Courier, in relation to the delayed delivery of goods, to the customer or third parties, meaning the contract concluded with the delivery of the goods to the Courier itself.

  4. Non-delivery: if the courier delivering the goods does not find any at the specified address, will store the goods in the warehouse indicated in the card that will be left on the spot. After thirty days of storage the goods will be sent back to the Company and the customer can not assert any right. All costs, direct and indirect, will be entirely borne by the customer. The Agricultural Company Podere San Bartolomeo will keep the payment of the goods as a penalty. If the customer requests the company to get back the products ordered and paid for, subject to non-delivery, must make a request within 48 hours to the Agricultural Company Podere San Bartolomeo by email. He will be responsible for all additional shipping costs.

  5. Delivery and packaging costs: if due, according to the type of order, are separated from the price of the products and indicated explicitly when placing the order.

  6. Fiscal receipt / Invoice: for each order placed on the site, the Agricultural Company Podere San Bartolomeo will issue a receipt and / or invoice showing the price of all items and will be placed inside the package. The request for an electronic invoice must be accompanied at the time of order by the indication of the recipient's code.

  7. Returns policies: The mismatch between the goods ordered and those delivered must be promptly communicated to the Agricultural Company Podere San Bartolomeo.

10.1: Right of withdrawal: Under Article. 5 DL 185/1999, if the customer is a Consumer has the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except as indicated in this article.

It should be noted that this right is reserved exclusively to individuals, customers and consumers who purchase goods for purposes not related and unrelated to their professional activity. There is no right of withdrawal to professional customers, whether natural or legal persons, who act in relation to the purchase contract in a professional context. To exercise this right, the consumer must express to the Agricultural Company Podere San Bartolomeo the willingness to withdraw, within 14 working days from the date of receipt of goods in the case of goods, or from the day of conclusion of the contract online for services. This notice must be sent by registered letter with acknowledgment of receipt addressed to Podere San Bartolomeo Società agricola semplice, with registered office in Santa Luce (PI), Via San Bartolomeo 19, always sent within the aforementioned period of 14 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent within the next 48 hours. Once the above mentioned notice of withdrawal has been received, the Company will quickly communicate to the Consumer the instructions on how to return the goods, intact and in their original packaging, which must take place within the next 48 hours.

10.2: In any case, the right of withdrawal is, however, subject to the following conditions:

- This right applies to the product purchased in its entirety, you can not exercise withdrawal only on part of the product purchased;

- the goods purchased must be intact and returned in their original packaging, complete in all its parts (including packaging and any documentation and accessories), without any lack.

- This right does not apply to products made to measure or clearly personalized.

10.3: The shipping costs related to the return of the goods are entirely borne by the consumer. The goods, until the certificate of receipt in the warehouse of Podere San Bartolomeo, is under the full responsibility of the consumer.

In any case, the Company is not liable in any way for damage or theft / loss of goods returned by uninsured shipments.

10.4: Podere San Bartolomeo, in case of withdrawal, will refund the Consumer the full amount already paid, within 14 days from the date of receipt of goods and, in any case, no later than 30 days from the communication of the Consumer. It will be the responsibility of the Consumer to promptly provide the bank details on which to obtain a refund (IBAN code of the invoice holder).

10.5: The right of withdrawal is totally forfeited, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where the Agricultural Company Podere San Bartolomeo ascertains:

- the lack of the external package and/or the original internal packaging;

- the absence of integral elements of the product;

- damage to the product for reasons other than transport.

In the event of forfeiture of the right of withdrawal, Podere San Bartolomeo will return the goods purchased to the consumer sender, charging the same shipping costs.

10.6: Return of the product in case of non-compliant goods. The Customer may return the product, except as indicated in the preceding paragraphs, if the goods do not correspond to what was requested in the order. In this case, you may request the renewal of the shipment or the return of the amount paid to the Agricultural Company. In the event of exercising this right, the Customer must send an email to the Company specifying the nature of the non-conformity. The company, through feedback to the aforementioned email, will indicate the methods for the management of the return.
